Family Dispute Resolution

Changes have been made to the family law system to encourage parents to develop cooperative parenting solutions without going to court. Family dispute resolution is a practical way for separating families to try to resolve any disagreements and make arrangements for the future.

Our Family Dispute Resolution/Mediation services include: education, information, counselling, and dispute resolution to help couples and families resolve conflict.

Mediation forseparated families assists parents to worktogether, and reach agreements which are in the best interest of their children. In mediation these parents will work towards establishing a parenting plan and a cooperative parentingstyle.

The familydispute resolutionprocess involves:

  • Parties listening to each other with respect
  • Identifying issues which need to be resolved
  • Sharing relevant information
  • Exploring ideas and options
  • Testing possible solutions
  • Negotiating agreements

The mediationprocess not only ensures a child focussed outcome; but saves in the high costs anddelays associated with the court system.

Child Inclusive mediation is also available, when appropriate,to support the rights of the child in parental conflict. It aims to reduce potential emotional and developmental burdens for children that are, unfortunately, the frequent victims of marital distress. Research on the impact of marital conflict and its costs for children provide compelling rationale for providing support, and strengthening of parental capacity during the process of separation.

The Family Dispute Resolution process usually consists of an initial interview for each party (1 hour) and Mediation(3 hours). If child inclusive mediation is required thenconsultation timewith the child/children is also required, the mediation process will also be extended to 4 hours in these circumstances.
